These terms govern your use of the Machete DGX mobile app. Installing or using the app means you accept them. If you do not, do not use the app.

What the app is

Machete DGX connects to hardware you control, over SSH, and lets you monitor and operate it. It is a client. It does not host, supply or manage any server on your behalf, and it stores nothing of your machine's contents on our systems.

Your responsibilities

• You must be entitled to access the machines you connect to.
• Commands you issue — starting and stopping containers, deleting files, running shell commands, unloading models — execute on your machine with your privileges. You are responsible for their consequences.
• You are responsible for keeping the device holding your credentials secure.
• You must comply with the licences of any model or software you download to your machine through the app, including model licences that require accepting terms on the provider's site.

Accounts

An account is optional; the app works without one. If you create one, keep your credentials confidential. We may suspend an account that is used to break these terms or the law.

What you publish

The app has a community area where you can publish model recipes: a title, a description, tags and the configuration itself. Anything you publish there is visible to every signed-in user, under the name derived from your account.

• There is no tolerance for objectionable content. Do not publish anything abusive, harassing, hateful, obscene, defamatory, unlawful, or that infringes anyone's rights. Do not publish other people's personal data, credentials or secrets. Do not use the area for advertising.
• You keep the rights to what you publish and give us permission to display it inside the app.
• Every published item can be reported by any user, from the menu on the item itself. A reported item disappears from the reporter's feed at once, and is withdrawn from everyone automatically once enough independent reports accumulate.
• Any user can block an author; blocked authors' items stop appearing for them permanently.
• We remove content that breaks these rules and we may suspend or terminate the account that published it, without notice. Reports reach us at [email protected] and we act on them within 24 hours.
• You can delete your own published items at any time from the app.

Pro subscription

• Pro is an auto-renewing subscription sold through the Apple App Store or Google Play. The current price, in your currency, is shown in the store before you confirm.
• Payment is charged to your store account on confirmation.
• The subscription renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before it ends.
• Manage or cancel it in your store account: on iOS in Settings → your name → Subscriptions; on Android in Google Play → Payments and subscriptions. We cannot cancel it for you.
• Deleting your Machete DGX account does not cancel a subscription and does not issue a refund.
• Refunds are handled by Apple and Google under their own policies.
• Where a free trial is offered, any unused part is forfeited if you buy a subscription during the trial.

For purchases on iOS, Apple's standard End User Licence Agreement also applies.

Availability and changes

The app is provided as it is. Individual features can be switched off remotely for maintenance or when a dependency breaks, and a minimum supported version may be enforced so that an obsolete build does not corrupt anything on your machine. We do not promise uninterrupted availability of the optional account and sync service.

Liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, lost data, lost profit, or damage to your hardware or workloads arising from your use of the app. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for intentional fault. If you are a consumer, your statutory rights are unaffected.

Termination

You may stop using the app at any time and delete your account from inside it. We may end these terms if you break them materially.

Governing law

Polish law applies. If you are a consumer, you also keep the protection of the mandatory rules of the country you live in. Disputes with consumers may be brought before the courts of that country.
